Litigation Guardian

In Ontario, when a person is mentally incapable of making certain decisions they cannot commence a legal action or, in the event that a legal proceeding has already started, they cannot provide instructions to their lawyer.  In this event a Litigation Guardian can be appointed to make decisions on behalf of the incapable person and take control over the litigation process as their guardian to continue and manage the case in the best interests of the incapable person.
